Can You Sue a Hotel for Food Poisoning?

Yes, you can sue a hotel for food poisoning if there is evidence that food prepared and/or served at the hotel caused your food poisoning case.

  1. Know what bug (bacteria or virus) made you sick. To have a claim for food poisoning, you need to be diagnosed with illness from a specific bad bug, generally one of the following: Campylobacter, E. coli, Hepatitis A, Listeria, Norovirus, Salmonella, Shigella or Vibrio.
  2. Notify your health department and make sure PFGE testing is done. If the bug that made you sick is bacterial, your local health department will do pulsed-field gel electrophoresis (PFGE) testing to determine the genetic fingerprint of the bacteria. Each outbreak of bacterial illness is caused by a bacteria with a unique genetic fingerprint (PFGE pattern). These patterns are put into CDC database called PulseNet. In this way, illnesses in different states can be connected to find an outbreak.
